Privacy Policy

This document provides information about the principles of data processing policy of SoftPatrol. When processing personal data, we comply with rules of Data Protection act and the objective of SoftPatrol is to be your reliable partner who respects your rights, and to set an example of others on the market.

1. Definitions

• Data Subject is a natural person about whom SoftPatrol possesses information or information based on which it is possible to identify a natural person. For instance, Data Subjects are Customers and drivers (i.e. natural persons) about whom SoftPatrol possesses Personal Data.
• 1.2 Privacy Policy is the present text which stipulates the principles of Personal Data Processing.
• 1.3 Personal Data is any information about an identified or identifiable natural person.
• 1.4 Personal Data Processing is any operation performed with the Personal Data of the Data Subject. For instance, collection, saving, arrangement, preservation, amendment and allowing access, performance of queries and making of extracts, use, forwarding, cross-use, connection, closure, erasing or destruction of data or the combination of several operations indicated above, regardless of the way such operations are performed or the means used for the performance of such operations.
• 1.5 Customer is any natural or legal person who uses or has expressed their wish to use the Services of SoftPatrol.
• 1.6 Agreement is the Service agreement or any other agreement concluded between SoftPatrol and the Client.
• 1.7 General Terms and Conditions establish the general terms which are applied when entering into a contractual relationship with SoftPatrol.
• 1.8 Services are any services and products offered by SoftPatrol, including the information society services belonging in the Product Portfolio of SoftPatrol.
• 1.9 User Account is the personal account of the Data Subject, which primarily gives him/her access to the digital products of SoftPatrol, and through which the Customer can identify himself/herself. These defined terms are used in the above-mentioned meaning in the PrivacyPolicy, Agreement, General Terms and Conditions and in the communication between the parties.

Restrictions

Without first obtaining the written consent of our products, you may not assign your rights and obligations under this Agreement, or redistribute, encumber, sell, rent, lease, sublicense, or otherwise transfer your rights to the dispatch system

Disclaimer

SoftPatrol makes no warranty that the software product will meet your requirements or operate under your specific conditions of use. user bear sole responsibility and all liability for any loss incurred due to failure of the software product to meet your requirements.

under no circumstances shall SoftPatrol be liable to you or any other party for indirect, consequential, special, incidental, punitive, or exemplary damages of any kind (including lost revenues or profits or loss of business) resulting from this agreement, or from the furnishing, performance, installation, or use of the software product, whether due to a breach of contract, breach of warranty.

Governing Law

This Agreement is governed by the laws of United Kingdom.

Severability

If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are not permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.

Apps

The driver app collects location data constantly whether the app is on the screen or hidden in the background. The data is provided to driver’s concerned office for his/her where abouts so that nearest job can be timely sent to the driver. When office get location information, they allocate the nearest job and also notify the customer that driver is available in the surrounding area.

Necessary:

From time to time the update is required by a third party (Google, Apple, Payment Providers, etc.). Usually it is due to technology progress and changes to their policy but not limited only to these. We try our best to provide an immediate update to apps

Tracking :

The app is designed to help office or control system stay informed about whereabouts of guards and if they are safe and moving on the location. The app simply provides a simple yet effective way for control centre to see how often guards are moving and where abouts they are stationary all during work hours.

Data Retention :

We retain your data for up to 30 days after receiving an account deletion request. Your account and associated data will be permanently deleted upon your confirmation at the end of this period.

Non-Sharing of User Data :

We do not sell, rent, or share your personal information with any third party for marketing or advertising purposes. The only parties with whom your data is shared are described in the "Data Sharing" section below.

Background Location Updates:

The App collects your device's precise location continuously, including when the App is in the background or closed, for the purpose of:

• Reporting your live position to the SoftPatrol company so they can assign nearby jobs;
• Verifying arrival at site address;
• Recording route data for trip auditing, dispute resolution, and safety;
• Allowing the dispatch office to confirm that the on-duty driver/guard is at the assigned location.

Background location collection is essential to the core function of the App and is only active while you are signed in and on duty. You can disable location at any time from your device settings, but the App will be unable to perform its primary function while it is disabled.

Other Data We Collect:

• Account information: name, phone number, and the credentials assigned to you by your dispatch office, used for sign-in and identification.
• Device information: device model, operating system version, and a unique device identifier, used to bind your account to your assigned device and to assist with technical support.
• App diagnostics: anonymous crash logs, error reports, and performance metrics, used solely to detect and fix bugs.
• Activity recognition signals: the App uses Android's Activity Recognition permission only to determine whether the device is stationary or moving, so that location updates can be paced efficiently and to save battery. We do not store, transmit, or analyze this signal as health, fitness, or medical information.

Health Data — We Do Not Collect Any:

• Fitness or exercise data;
• Medical records or clinical information;
• Heart rate, sleep, calories, or any biometric measurement;
• Google Fit, Apple Health, or Health Connect data.

The Activity Recognition permission, where used, is restricted to motion-state detection as described in Section 3 and is never used for any health or fitness purpose.

Data Sharing:

Your data may be shared only with:

• The guard tracking company you are assigned to, so they can allocate jobs and supervise operations;
• Law enforcement or regulatory authorities, where required by a valid legal request;
• Service providers strictly necessary to operate the App (cloud hosting, push notifications, crash reporting). These providers are contractually bound to use the data only for those purposes.

We do not share your data with advertisers, data brokers, or any third party for marketing or profiling.
